Other Provisions as Required by Law

Your child’s educational records will be protected by My Virtual Academy (MVA) as required by the Family Educational Rights and Privacy Act (“FERPA”) and applicable state laws regarding the privacy of student records or PII, Personal Identifiable Information. Be assured that we will only disclose education records or provide access to them in compliance with FERPA and applicable state laws.  We will require third parties that contract with us and have access to educational records to do the same.

MVA will not:

– Use PII to target a student for advertising

– Sell PII or use PII to create profiles about a student (other than for purposes of the student’s education in a local school) when those activities are prohibited by law.

– Use a student’s PII for purposes unrelated to providing or improving their education where required by law to do so.

If any provision of this Privacy Policy conflicts with FERPA or other federal or state law, MVA will comply with the more protective standard for the education records.

Annual Notice to Students

FERPA is a Federal law that is administered by the Family Policy Compliance Office (Office) in the U.S. Department of Education (Department). 20 U.S.C. § 1232g; 34 CFR Part 99. FERPA applies to all educational agencies and institutions (e.g., schools) that receive funding under any program administered by the Department. Parochial and private schools at the elementary and secondary levels generally do not receive such funding and are, therefore, not subject to FERPA. Private postsecondary schools, however, generally do receive such funding and are subject to FERPA.
